Welcome to Melbourne Home & Living. In these terms the words "we", "us" and "our" refer to Melbourne Home & Living, and "you" refers to anyone who visits or buys from this website. By browsing the site or placing an order, you agree to the terms set out below, along with any other policies we link to from here. If any part of these terms doesn't sit right with you, please don't continue to use the site.

Our store runs on the Shopify platform, which provides the online systems that let us sell to you. We may add new features or tools to the site from time to time, and those additions are covered by these same terms. We can revise any part of this page whenever we need to by posting the updated version here, so it's worth checking back now and then — continuing to use the site after a change means you accept it.

Using our online store

By agreeing to these terms you confirm that you are at least the age of majority in your state or territory, or that you are of that age and consent to any minor in your care using the site. You may not use our products for any unlawful or unauthorised purpose, and you must not break any laws that apply to you while using our service, including copyright law. Sending malicious code of any kind — viruses, worms or anything similar — is strictly prohibited and will end your access immediately.

General conditions

We may decline to serve anyone at any time, at our discretion. Your content (but never your card details) may travel unencrypted across networks and be adjusted to suit the technical needs of the systems it passes through; card information is always encrypted in transit. You agree not to copy, resell or exploit any part of the service or the site without our written permission. Section headings on this page are there for convenience and don't affect how the terms are read.

Information on the site

We do our best to keep the site accurate and current, but we can't promise every detail is always complete or up to date. Anything shown here is for general guidance and shouldn't be your only source when making a decision — check with a more authoritative source where it matters. Some material may be historical and included only for reference. We can change the site's contents at any time but aren't obliged to keep everything updated, and keeping an eye on changes is up to you.

Pricing and availability

Prices and product availability can change without notice. Stock levels shown on the site are a guide only; they can fall out of date, and where an item turns out to be unavailable after you order, we'll cancel and refund that order. We may modify or withdraw any product or part of the service at any time, and we won't be liable to you or anyone else for doing so.

Orders and accounts

We reserve the right to refuse or cancel any order, and to limit or cancel quantities bought per person, per household or per order — including orders that share a customer account, card, or billing or delivery address. If we change or cancel an order, we may try to reach you using the contact details you provided at checkout. We may also limit or refuse orders that look like they come from dealers, resellers or distributors. You agree to give us accurate, current and complete purchase and account information, and to keep it up to date so we can process your orders and reach you when needed.

Third-party tools and links

We may give you access to third-party tools that we neither monitor nor control; these are offered "as is" and "as available", without warranty, and using them is at your own discretion and risk. Parts of our service may also feature material or links from third parties. We're not responsible for the content, accuracy or practices of any third-party site, and we're not liable for any loss connected with goods or services you obtain from them. Please read their terms and policies before dealing with them, and direct any concerns about their products to them.

Your submissions

If you send us ideas, suggestions or other material — whether we ask for them or not — you agree we may use, edit, copy, publish and distribute them without restriction, without any obligation to keep them confidential, pay for them, or respond. We may remove content we consider unlawful, offensive or otherwise objectionable. Anything you submit must be your own, must not breach anyone else's rights, and must not contain unlawful or abusive material or malicious code. You're responsible for what you submit and its accuracy, and you may not impersonate others or mislead us about the origin of your content.

Prohibited uses

On top of the other restrictions in these terms, you must not use the site or its content: for any unlawful purpose or to encourage unlawful acts; to break any applicable laws or regulations; to infringe anyone's intellectual property; to harass, abuse, harm or discriminate against others; to submit false or misleading information; to upload viruses or malicious code; to collect or track others' personal information; to spam, phish or scrape; for anything obscene or immoral; or to interfere with the site's security features. We may end your access for breaching any of these.

Disclaimer and limitation of liability

We don't guarantee that your use of the service will be uninterrupted, secure, timely or error-free, or that the results will be accurate or reliable. Except where stated by us, the service and everything delivered through it is provided "as is" and "as available" without warranties of any kind, to the extent the law allows. Nothing in this section excludes the guarantees you're given under the Australian Consumer Law, which cannot be contracted out of. Subject to those rights, we and our directors, employees, suppliers and service providers won't be liable for any indirect, incidental or consequential loss — including lost profits, lost data or replacement costs — arising from your use of the service or any product, to the maximum extent permitted by law.

Indemnity

You agree to indemnify and hold harmless Melbourne Home & Living and our related parties from any claim or demand, including reasonable legal costs, arising out of your breach of these terms or the policies they incorporate, or your breach of any law or the rights of a third party.

Severability

If any provision of these terms is found to be unlawful or unenforceable, it will still apply to the fullest extent the law allows, and the part that can't apply will be treated as separate without affecting the rest.

Termination

Obligations and liabilities that arose before termination survive it. These terms stay in effect until either you or we end them: you can end them by no longer using the site, and we may end them if we believe you've breached them, in which case you remain responsible for amounts owed up to that point and we may withdraw your access.

Governing law

These terms, and any separate agreements through which we provide you services, are governed by the laws of Queensland, Australia.

Changes to these terms

The current version of these terms always lives on this page. We may update or replace any part of them at our discretion by posting the change here, and it's your responsibility to check periodically. Continuing to use the site after a change means you accept it.
